The 357 Corporation at the Supreme Judicial Court on December 1, 2008 on behalf of seven civil rights and advocacy groups discussing the scope of the investigation rule and continuing violation doctrine in employment discrimination cases.

employment law guide image As part of the Boston Bar Association’s Public Service Initiative, Nina and          Justine were instrumental in publishing the BBA’s Employment Law Guide: A Practical Guide to Understanding Massachusetts Employment Law, a publication of the Labor & Employment Section. The Guide was drafted by a group of attorneys who represent both employees and management and was created to assist employers and employees in Massachusetts in understanding their rights and obligations in the workplace. Justine organized the project over a two-year period and was a contributing author. Nina served as the editor of the Guide and a contributing author. At MCLE’s “Employment Law Conference” in December 2005, Nina presented on the topic of “Settlement Agreements in Employment Cases.”

In October & November 2005, Justine was a member of the subcommittee of the Boston Bar Association Education Committee responsible for developing and producing the program series “Following the Rules: A Program Series on the Trickiest Rules of the Trade.”

Nina presented on the topic of “Common Law Claims” at MCLE’s “Employment & Labor Law Basics” seminar in October 2005.

Nina was honored to be elected a Member of the Council of the BBA in elections held over the summer. The BBA Council is part of the governing board of the BBA whose mission it is to “advance the highest standards of excellence for the legal profession, to facilitate access to justice, and to serve the community at large.” Her term of service on the BBA Council is a three-year term ending in August 2008.

In October 2004, Nina presented to the Flaschner Judicial Institute on “Recent Developments in G.L. c. 151B Employment Discrimination Cases” to educate judges on developments in employment discrimination law.

Nina was a Co-chair of MCLE’s program, “The Court Year in Review: Employment Law” in September 2004.

Justine was a faculty member and trainer for the EEOC/FEPA Trial Training, “Narrative Direct and Constructive Cross-Examination Exercises” in September 2004.

Nina and Justine co- wrote an article published in Massachusetts Lawyers Weekly on August 9, newspaper2004, “Stonehill College v. MCAD: The More Things Change, The More They Stay the Same.”

In July 2004, the BBA featured Nina as its “Member on the Move” in Massachusetts Lawyers Weekly.

Justine was a presenter on the topic of “Labor and Employment Issues” at the Boston Bar Association’s Continuing Legal Education’s program “Legal Issues Surrounding Marriage for Gay and Lesbian Couples” in May 2004.

In May 2004, Justine presented on the topic of “Trial Practice Tips” at the Massachusetts Bar Association’s program “Jury Trials in Employment Discrimination Cases: Techniques for Success.”

In the winter of 2004, the attorneys were pleased to publish a chapter entitled “Employment Law 101” in Aspatore Books’ Winning Legal Strategies in Employment Law.

2003

At MCLE’s “Employment Law Conference” on December 5, 2003, Nina was a panelist on “Whistleblower Claims: Retaliation Claims and Sarbanes-Oxley.”

Nina presented on the topic of “Common Law Claims” at MCLE’s “Employment & Labor Law Basics” seminar in October 2003.

In September 2003, Nina began her term as Co-chair of the BBA’s Solo and Small Firm Section, which is comprised of attorneys in all of the solo and small firms that are members of the BBA. She will serve in the position until August 2005.

In April 2003, Nina and Justine participated in the National Employment Lawyers Association New England Regional Conference. Nina was a panelist at the workshop on “Depositions: Successful Strategies and Practices; Recurring Issues and The Solutions,” and Justine presented at the workshop on “Attorney’s Fees: How To Collect Fees Ethically And Successfully; Defending Against Costs/Fees.”

Nina was the Chair of the BBA seminar on “Retaliation Claims: The Tail That Wags The Dog” in March 2003.

2002

In December 2002, at MCLE’s “Employment Law Conference,” Nina was a panelist at the FMLA Workshop.

legal briefs imageIn November 2002, Nina and Justine were honored to be asked to co-author an amicus brief on behalf of Professors of Remedies, Constitutional Law and Litigation in Goodridge v. Department of Public Health, at the Supreme Judicial Court in support of same-sex marriage, urging the Court to apply a judicial remedy. Goodridge was decided in November 2003, a landmark ruling in which the SJC recognized constitutional rights of same-sex couples to marry. Applying a judicial remedy (which was argued in our amicus brief), the SJC was the first court in the nation to order that marriage licenses be issued to same-sex couples, thus making Massachusetts the first state to allow gay marriage.

Nina presented on the topic of “Common Law Claims” at MCLE’s “Employment & Labor Law Basics” seminar in October 2002.

At MCLE’s “U.S. Supreme Court Year in Review” seminar in October 2002, Nina presented on the topic of Continuing Violations.

Justine was the moderator of the MCLE’s “Presenting and Defending Your First (or Next) MCAD Case” program in August 2002.

2001

Justine presented on the topic of “Understanding the Implications of Employment Discrimination Cases from the Plaintiff’s Point of View” at the Council on Education in Management’s “Massachusetts Personnel Law Update 2001” program in November 2001.

In November 2001, Justine was the moderator of the MCLE’s “MCAD Management Team Roundtable 2001.”

Justine will start her term as Co-chair of the BBA’s Labor & Employment Law Section on September 1, 2001. She will serve a two-year term as Co-chair. The Labor & Employment Law Section is one of 24 Sections of the BBA which has six committees and six liaison committees delivering programing, events, and legal updates to its members. Justine has been a member of the BBA Labor & Employment Law Section since 1998.

Justine was Co-chair and a presenter on the topics of “Pre-certification and Certification Procedures Before the MCAD” and “Conduct of the Hearing and Post-Hearing Issues” at MCLE’s “Presenting and Defending Your First MCAD Case” program in August 2001.

Justine was the moderator of the Boston Bar Association Labor & Employment Section’s Brown Bag Luncheon on the topic of “Navigating Rule 4.2” in February 2001.

In February 2001, Justine was Co-chair and a presenter on the topic of attorneys’ fees for the Labor & Employment Section of the Boston Bar Association’s Continuing Legal Education Program “Attorneys’ Fees & Punitive Damages: Put But Money In Thy Purse.”

Justine was the moderator of the Boston Bar Association Labor & Employment Section’s Brown Bag Luncheon on the topic of “The EEOC’s National Enforcement Plan” in January 2001.

2000

1999

Nina presented the plaintiff’s perspective on the Family and Medical Leave Act at MCLE’s “Employment Law Conference 1999” in December 1999.

Justine was the moderator of the Boston Bar Association Labor & Employment Section’s Brown Bag Luncheon on the topic of “Punitive Damages” in November 1999.

In September 1999, Nina began her term as Chair of the MBA Labor and Employment Section Council. The Section Council is the governing body of the MBA’s Labor and Employment Section, which is made up of labor and employment attorneys throughout Massachusetts. Nina’s term as Chair runs from September 1999 to August 2000.

In May 1999, Nina’s committee drafting Maternity Leave Guidelines completed its work and submitted the proposed Guidelines to the MCAD. The MCAD issued the final Guidelines on the Massachusetts Maternity Leave Act in April 2000.

Nina presented “Employment Legislation and Regulations” at the MBA’s20th Annual Labor & Employment Law Spring Conference” in April 1999.

Justine was a presenter on the topic of “MCAD Practice Tips” at the MCLE’s “Employment & Labor Law Basics” seminar in 1999.

1998

Justine presented on the topic of “Current Practice Issues Before the MCAD” at the MCLE’s “Employment Law Conference ‘98” seminar in December 1998.

Nina was a panelist at a seminar on employment discrimination on the topic of: “Discovery in Employment Discrimination Cases,” for the American Bar Association in October 1998.

In fall 1998, Nina was a panelist at a Luncheon Roundtable at the Massachusetts Bar Association on the topic of recent U.S. Supreme Court decisions on sexual harassment.

Nina was a panelist at an MBA seminar in October 1998 and an MCLE seminar in June 1998 on sexual harassment. She presented on the topic of liability of individual supervisors and coworkers for sexual harassment.

In September 1998, Nina was honored to be appointed Vice Chair of the MBA Labor & Employment Section Council.

Justine was the Chair and moderator at the MBA’s “MCAD’s New Disability Guidelines: The Final Version” program in June 1998.

In May 1998, Justine presented on the topics of “Drafting and Filing the Charge of Discrimination,” “Assessing and Responding to a Finding of Probable Cause or Lack of Probable Cause,” and “Conduct of the Hearing” at the MCLE’s “Presenting Your First MCAD Case” seminar.

April 1, 1998 was opening day for Kimball & Brousseau LLP!

In 1998, Nina was asked to co-chair a bipartisan committee of employment attorneys to draft Maternity Leave Guidelines for the Massachusetts Commission Against Discrimination to interpret and apply the Massachusetts Maternity Leave Act.  

Nina served on the bipartisan committee to draft Sexual Harassment Guidelines for the MCAD, which began its work in 1998.

In March 1998, Justine was the Chair and moderator of the MBA’s “Electronic Communications in the Workplace” luncheon roundtable program.

Nina was a panelist at the MBA’s Annual meeting, presenting a seminar on “Individual Liability in Employment Cases” in March 1998.

Justine was selected in 1998 to serve as Co-chair of the MBA subcommittee tasked to review and revise the MCAD Procedural Regulations.

picture of books (1)In March 1998, Justine wrapped up a three-year engagement as Co-chair of the MBA subcommittee responsible for drafting the revised MCAD Disability Guidelines. The subcommittee, which was comprised of a bipartisan group of employment attorneys, began its work in 1995. The proposed revised MCAD Disability Guidelines were adopted by the MCAD in March 1998 as the new MCAD Disability Guidelines governing practice before the MCAD.

In February 1998, Nina was a program speaker at the MBA’s Roundtable program on legal issues surrounding e-mail in the workplace.

Justine participated in a panel discussion on “Introduction to the New Regulations: Questions and Answers” at the MCLE’s “The New MCAD Regulations” seminar in the winter of 1998.

1997

Justine was the moderator of the MBA’s “Strategies for Using and Defending Against Expert Witnesses in Employment Discrimination Cases,” a luncheon roundtable program in December 1997.

In December 1997, Justine was a Co-chair and speaker providing an overview and discussion of relevant federal and state law from the Plaintiff’s perspective at the Metrowest Center for Continuing Education’s “Employment Discrimination Update `97: Handling Psychological Disability Claims and Related Current Developments.”

Nina was a panelist at MCLE’s seminar on “Use and Misuse of Computers and the Internet” in November 13, 1997, on the topic of: legal claims arising out of use and misuse of electronic communications in the workplace.

Nina and Justine conducted training of MCAD staff at the Massachusetts Commission Against Discrimination in the Summer of 1997.

In May and June 1997, Justine was a program speaker on the topic of “Employment Discrimination Laws: Federal, State and Common Law Tort Claims,” at the MBA’s “The Contingent Workforce – Emerging Legal Issues” programs.

Justine was a Co-chair and speaker on the topic of “Pre-Employment Inquiries” at the Metrowest Center for Continuing Education’s “Disability Law and the Workplace: What Every Employer (and Attorney) Needs to Know” program in May 1997.

Nina was the Chair of the MBA Seminar: “ADR at the MCAD: How it Works” on May 14, 1997.

Justine was a program speaker at the MBA’s “Drafting Favorable Jury Instructions and Special Verdict Questions – Plaintiffs’ and Defendants’ Views,” a luncheon program, presenting the plaintiffs’ view of how to get favorable information to the jury, in January 1997.

1996

Nina spoke on the Family & Medical Leave Act at the MBA Brown Bag Lunch Seminar Series in October 1996.

Justine was selected to serve as Chair of the MBA Employee Rights & Responsibilities Committee in 1996 for a one-year term. During her term as Chair, the Committee continued its work assisting the Massachusetts Commission Against Discrimination in reviewing and revising its Employment Regulations and its Disability Guidelines.

Justine spoke on the topic of “Interaction Among the FMLA, ADA, G.L. c. 151B, Workers’ Compensation Law and the NLRA” at the MBA’s “Emerging Employment Litigation Issues Under the Americans With Disabilities Act” program in June 1996.

In May 1996, Justine presented at the workshop on “Sexual Harassment” for the National Employment Lawyers Association’s New England Regional Conference.

Nina was a panelist on MCLE’s Seminar on “Drafting Employment Documents in Massachusetts,” speaking on the topic of the Family & Medical Leave Act in the spring of 1996.

Justine spoke on the topic of the “Express or Implied Employment Contract” at the MCLE’s “Wrongful Termination Update ‘96” seminar in February 1996.

Justine continues serving as Co-chair of the MBA subcommittee drafting revised MCAD Employment Regulations which began its work in 1994 and concluded by submitting draft regulations to the MCAD in 1996.

1995

Nina was a panelist on MCLE’s “Discrimination Law Update” seminar in October 1995, and presented on the topic of “Sexual Harassment and the First Amendment.”

In September 1995, Justine spoke on the topic of “Common Law Employment Tort Claims/Privacy/Drug Testing” at the MCLE’s “Labor and Employment Law Basics ‘95” seminar.

In 1995, Justine was appointed Vice Chair of the MBA Employee Rights & Responsibilities Committee which is a one-year term.

In 1995, in addition to serving as a Co-chair of the MBA Subcommittee responsible for drafting the Revised MCAD Employment Regulations, Justine has taken on the role of co-chairing the new MBA subcommittee responsible for drafting revised MCAD Disability Guidelines.   Nina served as a member of the MBA subcommittee tasked to revise the Disability Guidelines from 1995 to 1998.

Justine served as a Co-chair of the MBA subcommittee responsible for drafting Revised MCAD Employment Regulations from 1994 to 1996. In 1996, the subcommittee presented the proposed revised MCAD Employment Regulations to the MCAD, which after a public comment period, were adopted as the new MCAD Employment Regulations governing practice before the MCAD.

Justine participated in MCAD Investigator Training Sessions at the Massachusetts Commission Against Discrimination in 1994 & 1995.
